• Trial of judicial foreclosure actions resulting in judgment for our lender clients, and judgments against the guarantors of the loans, with awards of all attorneys’ fees incurred by our clients in the litigation.
• Negotiated and documented the restructure of complex real estate secured loans made to developers, incentivizing an orderly liquidation beneficial to our lender clients.
• Negotiated and documented business acquisitions and sales, including professional practices.
• Successfully enforced assignment of rents and appointed receivers for commercial properties located throughout Northern California and the Central Valley.
• Negotiated, documented and closed numerous loan sales transactions on behalf of lender clients.
• Successfully litigated preference and fraudulent property transfers lawsuits in bankruptcy court.
• Negotiated and documented numerous commercial leases for our landlord and tenant clients.
• Negotiated and documented deeds-in-lieu of foreclosure on commercial properties, and the sale of commercial properties acquired through foreclosure.
• Obtained relief from the automatic stay in many bankruptcy matters, successfully objected to confirmation of reorganization plans in Chapter 11, Chapter 12 and Chapter 13 bankruptcies, negotiated terms of reorganization plans, successfully opposed cash collateral and other motions in the U.S. Bankruptcy Court.
• UCC foreclosures on wine storage facility, business assets, crops, accounts, livestock, equipment, followed by litigation to collect the deficiency.
• Successfully defended $22 million lender liability lawsuit and collected attorneys’ fees awarded to our client.
• Litigated to judgment or stipulated judgment hundreds of cases, and successfully obtained writs of attachment, writs of possession, and writs of execution.
• Successful record on appellate matters, including published cases in the 9th Circuit Court of Appeals, California Appellate Courts, and the Bankruptcy Appellate Panel.
• Obtained defense verdict after jury trial in favor of our real estate brokerage client who was sued for fraud and punitive damages.
• Collected or recovered substantial sums for our clients.
